Terms of Service

Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of EmailLeaked.com (the "Service"), operated by EmailLeaked ("we," "us," or "our"), based in Texas, United States. By accessing or using the Service in any way — including browsing content, using the breach checker, or signing up for the newsletter — you agree to be bound by these Terms in their entirety. If you do not agree to these Terms, do not use the Service. These Terms apply to all users, visitors, and others who access or use the Service.

Description of the Service

EmailLeaked provides a free, publicly accessible data breach checking tool that allows users to query whether an email address has appeared in known data breach datasets. The Service also provides security education content, guides, and informational articles intended for general audiences. Use of the Service does not require account registration and is provided at no charge. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice or liability.

Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service and that they have reviewed these Terms. By using the Service, you represent and warrant that you meet these eligibility requirements. Users in jurisdictions where the Service is prohibited by law are not permitted to use it.

Acceptable use

You may use the Service only for its intended, lawful purpose of checking email addresses against known breach datasets and reading security education content. Permitted use includes querying your own email addresses and those of individuals who have given you explicit permission to do so on their behalf.

The following uses are strictly prohibited: (a) using automated tools, bots, scripts, crawlers, or any non-human mechanism to submit queries or scrape content; (b) attempting to reverse-engineer, decompile, disassemble, or otherwise derive source code from any portion of the Service; (c) overloading, disrupting, or impeding the infrastructure of the Service or its underlying providers through denial-of-service attacks, excessive requests, or similar methods; (d) using results from the Service to harass, surveil, stalk, discriminate against, or otherwise harm any individual; (e) using the Service in any manner that violates applicable local, state, national, or international law; (f) submitting email addresses belonging to others without their consent; (g) attempting to circumvent any security, consent, or access-control mechanism on the Service; (h) reproducing, distributing, sublicensing, or commercially exploiting any content or data from the Service without written permission; (i) impersonating EmailLeaked or any affiliated entity in any communication.

We reserve the right to block IP addresses, terminate access, or take other remedial action against users who violate these provisions without notice and without liability.

No warranties — disclaimer of warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EMAILLEAKED EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

Without limiting the foregoing, EmailLeaked makes no warranty that: (a) the Service will meet your requirements or expectations; (b) breach data will be complete, accurate, current, uninterrupted, or error-free; (c) a "no breaches found" result means your email address has never been compromised or will not be found in future dataset releases; (d) any action taken based on Service results will prevent identity theft, fraud, account compromise, or other harm; (e) the Service will be available at any particular time or free from technical errors. Breach data is sourced from third-party providers whose coverage, accuracy, and timeliness are outside our control.

Indemnification

You agree to defend, indemnify, and hold harmless EmailLeaked and its operators, officers, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service in violation of these Terms; (b) your violation of any applicable law or regulation; (c) your infringement of any third-party right, including privacy rights, intellectual property rights, or other proprietary rights; or (d) any content or information you submit to the Service. EmailLeaked reserves the right to assume exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of such claim.

Intellectual property

All content on EmailLeaked.com — including but not limited to text, graphics, logos, icons, images, data compilations, software, and the compilation and arrangement thereof — is the property of EmailLeaked or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

You may not: reproduce, copy, duplicate, sell, resell, or exploit any portion of the Service without express written permission from EmailLeaked; use EmailLeaked's name, logo, trademarks, or service marks without prior written consent; or frame or mirror any portion of the Service on any other website or platform. Breach data displayed through the Service is sourced from third-party providers and remains subject to those providers' own intellectual property terms.

DMCA — copyright infringement notices

EmailLeaked respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe that material on the Service infringes your copyright, please submit a written notice containing the following information to info@emailleaked.com: (1) a physical or electronic signature of a person authorized to act on behalf of the copyright owner; (2) identification of the copyrighted work claimed to be infringed; (3) identification of the material you claim is infringing, with sufficient detail for us to locate it; (4) your contact information, including address, telephone number, and email address; (5) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (6) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

Counter-notifications may be submitted in accordance with 17 U.S.C. § 512(g). EmailLeaked reserves the right to remove allegedly infringing content and to terminate the access of repeat infringers.

Third-party links and services

The Service may contain links to third-party websites, tools, or services. These links are provided for convenience and informational purposes only. EmailLeaked has no control over and assumes no responsibility for the content, privacy practices, terms of service, availability, or security of any third-party sites. The inclusion of any link does not imply endorsement, recommendation, or approval by EmailLeaked. You access third-party sites at your own risk.

Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By accepting these Terms, you acknowledge and agree to our Privacy Policy.

Dispute resolution — mandatory arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service, or the breach, termination, enforcement, interpretation, or validity thereof (collectively, "Disputes"), shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except that either party may bring claims in small claims court if the claim qualifies. The arbitration shall be conducted in English in Harris County, Texas, or, at your option, by telephone or videoconference. The arbitrator's decision shall be final and binding on both parties, subject to limited review under the Federal Arbitration Act.

You agree that any arbitration proceeding will be conducted on an individual basis and not in a class, consolidated, or representative action. The arbitrator may award declaratory or injunctive relief only on an individual basis and only to the extent necessary to provide relief warranted by the claimant's individual claim.

YOU HAVE THE RIGHT TO OPT OUT OF THIS ARBITRATION AGREEMENT. To opt out, send written notice to info@emailleaked.com within 30 days of first accepting these Terms. Your notice must include your name and a clear statement that you are opting out of arbitration. If you opt out, any Disputes will be resolved in the courts described in the governing law section below.

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights or breach of confidentiality obligations.

Class action waiver

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND EMAILLEAKED AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING. If a court or arbitrator determines that this class action waiver is unenforceable with respect to any claim, then the arbitration agreement shall not apply to that claim, which must be brought in the courts described in the governing law section below. If any portion of this class action waiver is found unenforceable, the remaining portion shall remain in effect.

Governing law and jurisdiction

These Terms and any Dispute arising out of or related to them or the Service shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions, and without regard to the United Nations Convention on the International Sale of Goods. For any Dispute not subject to arbitration, you agree to submit to the exclusive personal jurisdiction and venue of the state and federal courts located in Harris County, Texas. If you are a consumer in the EEA or UK, mandatory consumer protection provisions of your local law may apply in addition to Texas law.

Severability and waiver

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms continue in full force and effect. No waiver by EmailLeaked of any term or condition set out in these Terms shall be deemed a further or continuing waiver of that term or condition or a waiver of any other term or condition. The failure of EmailLeaked to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Entire agreement

These Terms, together with our Privacy Policy, Disclaimer, Disclosure Policy, and Editorial Policy, constitute the entire agreement between you and EmailLeaked with respect to the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral, relating to the Service.

Changes to these terms

We reserve the right to modify these Terms at any time. When we do, we will update the "last updated" date at the top of this page. Material changes will be communicated on the Service for a reasonable period before taking effect. Your continued use of the Service after any modification constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
